The 14th amendment on citizenship rights was written to ensure slaves born in the USA would be citizens. It was never intended to apply to illegal aliens. However, it was interpreted to apply to aliens in a footnote to a 1982 SCOTUS ruling. This can be reversed by legislation which of course would be appealed back to the Supremes or with a lawsuit by a party that has legal standing. Either way it is not fair to taxpayers to be burdened by illegals taking advantage of this situation.

A great read on Conservative Review's website helps explain the original intent of the 14th Amendment.

- See more at: https://www.conservativereview.com/...ip-loophole-myth-vs-fact#sthash.1pAKKTCQ.dpuf

Excerpt:
Fortunately we need not speculate about their intent. The intent of the framers was crystal clear. The purpose of this amendment was to overturn the Dred Scott case and ensure guaranteed citizenship to all former black slaves born in American, and likely living here for generations. At the same time they wanted to limit citizenship to those subject to our jurisdiction, which excludes those who are not legal permanent residents of this country and certainly illegal aliens.

The 1866 Civil Rights Act, which was the forerunner to the 14th Amendment, reads as follows: “All persons born in the United States, and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States.” Anyone who is here illegally or on a temporary visa is still subject to the jurisdiction of his or her own country of origin.

Sen. Jacob Howard of Michigan, the principle author of the citizenship clause of the 14th amendment, explicitly said that candidates for citizenship must be born here AND not owe allegiance to another authority. He made it clear that allegiance "will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States." If we can be sure that even children of Indian tribes were excluded from automatic citizenship, certainly temporary visitors from foreign countries were meant to be excluded as well.

The problem is, it's there. It's been backed by a SCOTUS ruling and it's allowed two generations to become citizens under it.

It would take an amendment change or addition at this point and the cold hard fact is, that ain't happening. It just isn't.

This whole gotdamned immigration debate grates on my nerves. We and our leaders have stood by allowing tens of millions to dwell in quasi citizenship and or gain citizenship via the 14th.

They are here, tens of millions all among us. Good, bad, ugly, they're here.

This idea of suddenly rounding up millions of people's, many born and raised here, educated here, employed here, owners of business & real estate, members of society is just horse shit and and a pipe dream.

#1 SECURE the fvcking border then deal with the mess WE have created or at the least allowed to be created with humanity and each case on its own merit.

What I hear is a lot of criticism but very little constructive criticism. Trump’s immigration plan has some great points. Anchor babies aside. We don’t have to deport all illegals for his plan to be a success and make our country great again.

I hear no sympathy for taxpayers who are paying for illegal alien welfare, food stamps, EITC, UC, SSec,Medicare, Medicaid, education, housing, etc. I haven’t run the numbers but I suspect we would reduce the national debt. I don’t see any sympathy for citizens who are murdered, raped, or hit by drunk drivers who are illegals. Why the lack of sympathy for those who are unemployed and have to compete with illegals for jobs? Why no sympathy for the stagnant wages partially because we have too many illegal immigrant workers?

I don’t think u have to deport everyone all at once. If u enforce e-verify, there will be many who will leave on their own. If u deny welfare benefits to illegals, many more will go. Discontinue chain migration. Deport all criminal aliens. Clean up H1-B system with a biometric entry- exit system. H1-B overstays are a big factor in illegal immigration.

We don’t need to bring in 1 million legal immigrants a year when we have so many on food stamps and welfare. Why can’t we have a merit based system for bringing in immigrants? This can be done!

Completely agree. No way you're going to round up 11 million people and send them back to Mexico and South America. We caused this problem (Dems and Repubs) and must do something to correct the issue. Not all illegals are bad, most love this country more than people who go back generations. We need a comprehensive immigration bill that strengthens the boarders and deals with those illegals/DREAMers by bringing them out of the shadows and judging on a case by case bases if they deserve to be Americans.

That policy makes sense as long as you secure the border first. Otherwise it's just more of the same BS. Secure the freakin border...

Did you even read the article on the Conservative Review website? In addition, when was the last time the 14th Amendment was challenged in the courts, much less the SCOTUS. I don't know and I'm not going to spend much time looking for it. You stated it, you provide the evidence.

The correct interpretation of the 14th Amendment is that an illegal alien mother is subject to the jurisdiction of her native country, as is her baby. It's crystal gotdamned clear. Read the 1866 Civil Rights Act... https://en.wikisource.org/wiki/Civil_Rights_Act_of_1866

Securing the border should be top priority, with a wall and additional border guards where necessary. After the border is secure, we can start to clean up what the DEMOCRATS created. A complete mess of our immigration system. Which was their intended objective all along. So they could attempt to pass "Comprehensive Immigration Policy", in doing so create an additional 10-12 million voters beholden to the Democrats. Nice try, Libs. You can't win on your ideas so you destroy the country to build the party. I don't hate to tell you, the game is up and the Trump is coming.

After the border is secure, the proper authorities should round up every FELON nationwide and deport them to their appropriate jurisdiction or incarcerate them for a very very long time.

Are we going to round up 10-12 million illegals? Obviously not. But what we can do, thru the rule of law, is put the fear of God (and Trump) in them while giving them an ultimatum- wait for it - self-deport or turn themselves in and pay appropriate fines and taxes while coming thru the system correctly. You won't have to round them up, if they want to remain here then they should do the right thing.

We don't need comprehensive immigration reform. We need to obey the laws already on the books.

When did SCOTUS rule on the 14th amendment?

If we took away the incentives by enforcing E-Verify and took the welfare benefits from illegals, many would leave. Deport all criminal aliens. Gangs are a big problem and many gang members are illegal immigrants.. So we wouldn't need to deport all immigrants.

Well, I've mis read and Mis understood regarding the 14th being upheld.

My bad

Still don't believe it's right or possible to suddenly round up 10-20 million people and send them packing. It just won't happen.

What we can do is first and foremost secure the damned border and then deal with what and who we have here in a rational manner.

If u enforced e-verify and limited the welfare benefits, many would leave on their own so u wouldnt have to "round up" all the illegals. But a good start would be to deport all criminal aliens and gang members and a mandatory jail term if they returned. If we did that, it would be a great start. Eliminating chain migration, anchor babies & policing H1- B visas in the future would be a good start. I hear a lot of criticism which is designed to denigrate Trump's entire plan but not much constructive criticism from Trump's critics.
