Legal analysis: Let’s talk about House v. NCAA

Let me tag @LawDawg86 in this because he’s been crazy plugged in. I think some of the headlines are a little misleading because it seems like a done deal

1. What is the news right now? The news is that the NCAA member institutions have approved a settlement proposal to make to the Plaintiffs. There is no “deal” right now

2. What’s next? The offer goes to the plaintiffs. They have the opportunity to reject it in whole or in part. There is no “deal” right now

3. What else? If there’s an agreement, a judge has to approve it. Members of the class action will have an opportunity to object to it.

4. What else else? So this isn’t the end of litigation for the NCAA. There’s a case called Fontenot which is about athletes receiving money directly from the TV contracts. This is a separate case but the NCAA is going to argue that the House settlement should resolve Fontenot. This is very much up in the air.

5. What does it all mean, Basil? What it means is the agreement yesterday is a first step towards a settlement. The schools aren’t going to be directly paying players in the 2024-2025 year, and it’s *possible* this won’t even be resolved by the 2025-2026 year.

All this to say that the reporting yesterday made it seem like direct payment to players is imminent. It’s not in the nearest term. It’s coming in a year or two but it’s not here now.
