I know we have a few lawyers on the board and wanting some guidance. Back in February my daughter was in an accident in which she was at fault. While the accident was minor, the other party sustained a broken wrist.
State Farm ended up settling with that person and it’s my understanding that there is a requirement that she sign a release that prevents her from suing State Farm or us.
Fast forward to today and we were served with a summons - she is suing us. She has been paid - she signed the release. On what grounds can her lawyer be suing us?
I also understand that it’s unlikely I am liable for the accident - the circumstances don’t meet the criteria under the Family Purpose Doctrine.
Currently State Farm and their lawyers are working on this.
