ND - car accident legal question

Wife was rear-ended at a stoplight about a year ago. She's been fighting to get bills taken care of. Person who rear-ended her came to her door after the accident and apologized stating she was trying to grab her badge which had fallen on the floor.

Officer who responded to the scene found the driver at fault and cited her for reckless driving. Driver also told the officer she didn't see my wife stopped at the light.

Now this is going to court as the driver is recanting claiming my wife is at fault for coming to a sudden stop. (At a red light.)

Am I missing something? On the surface this seems like a dumb thing for the driver to fight as she admitted to the officer she didn't see my wife stopped.
