if the guy was over 64 and 365 days the disorderly conduct could be considered elder abuse and a statutory felony. Nerd or no nerd / size differential or no - it’s a felony.
which makes it felonious assault even w/o touching or a battery taking place.

Learned something today, thx. Had no idea I could beat someone down for saying nasty things to me. I just wonder what would have happened ,if everything went down like reported here , what would have happened if the nerd pulled a firearm and shot the old man “standing his ground”, in self defense after he walked up and slugged him, wouldn’t he be entitled to protect himself from an assault, or its considered a provoked attack essentially?? I would like to know that answer. I’m obviously ignorant of the facts here.

The initial aggressor would Go before 12 men & women for instigation and as a physical response would reasonably Foreseeable And then the escalation to deadly force would also fall onto the initial aggressor. So a jury would decide how much or if any $/penitentiary would be a consequence. Any kind of plea deal would likely be either a felony or close enough to it he would no longer be a UGA professor.

But let’s be clear about Georgia law, if you tangle with anyone 64 years + > 364 days - just about anything is a Statutory Felony under state law. Local prosecutors have much less if any leeway - it’s going to be a felony and felons do not own guns thereafter, don’t vote in most states, and can’t go on vacations out of the country for awhile as well as - they don’t work as UGA Profs.
