Not Sports But UGA Related: Laken Riley Trial Update

The murderer waived his right to a jury trial this morning. The judge also denied motions from the Defense for a continuance, a change of venue, and the exclusion of cell phone and DNA evidence. Bench trial now starts Friday morning.
Hope it’s fast and painful as possible for this ****ing low life POS.
 
This is odd. @RightAway any idea why they’d ask for a bench trial? Does the defense think the pre trial motions have validity and they’re just trying to get a verdict to appeal? I mean he’s getting life without parole regardless of whether it’s a judge or a jury but you can’t “hang” a judge

Unless they have changed the law can't the prosecution object to a defendants waiver of a jury trial in a murder case? Or is that just a death penalty case.

Good god. What must one person do to another to get the death penalty?

Imagine finding this body, face smashing in with a hammer, brain matter everywhere, just awful.

So the killer gets to live but the innocent get to die. That’s 2024 America for you.

Probably because they can’t get a non biased jury….
 
He’s here illegally send him back I don’t want to pay for his prison stay…short or long

my initial thought was sometimes you do this to get the "we didn't waste a jury's time, please don't give us the death penalty", but that's not even on the table right now.

I'm currently pushing for a bench trial in a felony because we have zero defense (everything alleged happened and in a very unsavory manner, jury would want to fry my guy) but we have some unique legal issues that a judge could decide in our favor. might be something similar

That’s my gut on this. I had heard that the defense believed he had some viable motions to suppress some evidence obtained without a warrant and I’m wondering if they’re just trying to move the trial along and get to his appeal.

Again, who knows but I don't think many criminally charged/convicted illegals will be in state/federal prisons much longer.
I can't imagine they would let those scumbags out. Without getting into politics they are targeting illegal criminals who were allowed in and not in prison.

Good point but the protections they have ends in late January, I'd guess him and other high profile criminal illegals will be on the first planes out but again we don't know.
 
That feels like the case here, @RightAway. There is zero doubt he murdered her, and the evidence supports that. I don't even think the defense is really denying that. The motions to suppress evidence came across as the defense throwing crap against the wall and hoping it stuck, because they have absolutely no chance in this trial. Their only hope is getting the most damning evidence excluded.

I will say I'm shocked the judge denied the change of venue though. You two obviously know way more about how trials and appeals work than I do (I'm just a lowly police officer after all lol), but that seems like an unforced error by the judge that could come back to bite him in the appeal process.
The standard on change of venue is pretty high. I haven’t looked at it in a long time but there’s a pretty strong presumption that people be tried in the venue of the crime. This one may have been close but I don’t have enough info as to whether he should have moved it

I do not agree on the motions to suppress though. I think they had some merit based on what I was told by people I respect. Enough that they should be granted? I don’t know. But it wasn’t throwing stuff against the wall

I was told several years ago by our district DA, who is now a State judge, that he doubted anyone would ever be given the death penalty in GA.
The reason: it costs too much money for the state to try the case

It’s WAY more expensive to try a death penalty case and keep someone on death row than to just let them die in prison. I think it cost about five times more per year. Plus the defense of the case costs millions instead of thousands.
 
With the current DA in this jurisdiction the death penalty is off the table. I say find him innocent and let nature take its course.

The expense of “death penalty” cases and then the many years of subsequent cost of keeping them on death row really does make it a losing option from a tax payer perspective. Add in that you can’t get a do over on a dead person and it’s not “worth it” financially.

If I remember, The cost is 2x-3x more and the average death penalty convict costs over $20M to bring to death.

I am a bit emotionally biased on this. This little girl was a grade school classmate with my niece and I was at a birthday party for her where Laken was there. I vaguely remember all those little girls that day. To say the least. I'd like to execute this SOB.
